Understanding Penal Code Section 261

In consideration of the seriousness of rape, California has criminalized it under Penal Code section 261. Under this law, “Rape is an act of sexual intercourse accomplished with a person who is incapable, because of a mental disorder or developmental or physical disability, of giving legal consent, and this is known or reasonably should be known to the person committing the act. The prosecuting attorney shall prove, as an element of the crime, that a mental disorder or developmental or physical disability rendered the alleged victim incapable of giving consent.” 

Basically, to convict someone of rape under PC 261, the prosecutor must prove each of the following elements beyond a reasonable doubt:

  1. The defendant willfully engaged in sexual intercourse with another;
  2. The defendant was not married to the person at the time;
  3. The person did not consent to the sexual intercourse;
  4. It was not reasonable for the defendant to believe that the victim had consented. 

 

Rape is a Felony

Felony Rape Penalties

  • A maximum sentence of 3, 6, or 8 years in California state
  • prison;
  • A fine of up to $5,000;
  • Formal probation;
  • Lifetime duty to register as a sex offender. 

  

Enhancements for Rape

An enhancement offense is an offense whose commission alone increases the penalties for the original crime. In California, if you are charged with the rape, you could be facing the following sentence enhancements:

Rape of a Minor

  • A minimum sentence of 7 years in California state prison;
  • A maximum sentence of 13 years in California state prison.

It is important to note that for purposes of this enhancement, it matters that you did not know the person was a minor or reasonably believed the person to be over 18 years old.

Rape Resulting in Great Bodily Injury

  • An additional 3-5 years in California state prison;
  • A maximum fine of $10,000;
  • A strike under California’s Three Strikes Law.

 

Implications of PC 290 for Rape

California Penal Code section 290 requires sex offender registration for anyone convicted of rape. Registration consist of the person's head shot, known aliases, general description, latest address, and details of the offense and conviction. Sex offender registration is a lifetime duty, a registered sex offender will have to update this information with DOJ annually, within five working days of their birthday and each time they change residence, within five days of the move. The Sex Offender Tracking Program will keep track of the next required update and if a registered sex offender is in violation of the update requirements. All of this information will go on a registered sex offender database that will be published by the California Department of Justice on Megan's Law web site. Megan's Law web site has been established for local law enforcement agencies to notify the general public about sex offender registrants that may pose a risk. More importantly rape is an aggravated felony, regardless of the actual sentence the judge imposes at sentencing.
